TERMS AND CONDITIONS
1) Definitions
Member: any person or group who is a customer of Gainesville Table Tennis Community means a person availing themselves of services provided by the Club and ‘persons under the Member’s control’ includes individuals claiming by, through or under the Member and any other person in or about the Member at any time at the request or invitation of or under the control or direction of the Member and where the context permits any of them
Club: means a Sports Club run by the Gainesville Table Tennis Community
2) Liability Consent Waiver
In consideration of being permitted to participate in any way in Gainesville Table Tennis Community events, the member and/or their minor child, personal representatives, assigns, heirs, and next of kin:
a. Acknowledge, agree, and represent that the member and/or their minor understand the nature of table tennis activities and that their minor child are qualified, in good health, and in proper physical condition to participate in such activity. The member further agrees that if at any time they believe conditions or equipment to be unsafe, they and/or their minor child will immediately discontinue further participation in the activity.
b. Fully understand that (a) table tennis activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis and death, harassment, exposure to inappropriate conduct and language ("risks"); (b) these risks and dangers may be caused by the member and/or their child's own actions, or inaction, or the actions or inaction of others participating in the activity, the condition in which the activity takes place, or the negligence of the "releasees" named below; (c) there may be other risks and severe social and economic losses either not known to me or not readily foreseeable at this time; and the member fully accepts and assumes all such risks and all responsibility for losses, costs, and damages they and/or my minor child incur as a result of their participation in the activity.
c. Hereby accept and assume all such risks, known and unknown, and assume all responsibility for the losses, costs, and/or damages following such injury, disability, paralysis, or death, even if caused, in whole or in part, by the negligence of the "releasees" named below;
d. Hereby release, discharge, and covenant not to sue Gainesville Table Tennis, their respective administrators, directors, agents, officers, officials, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the "releasees" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations; and the member further agrees that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement the member and/or their minor child, or anyone on the member and/or their minor child's behalf, makes a claim against any of the releases, they will indemnify, save, and hold harmless each of the releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
e. The member read this agreement, fully understood its terms, understood that they gave up substantial rights by participating in Club activities, and agreed to it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
